Terms and Conditions

1. Information on how to enter and prizes form part of these Terms & Conditions. Any entry not complying with these terms and conditions is invalid. Participating in this promotion is deemed acceptance of these Terms and Conditions. 
2. Entry is open to residents of Australia. Employees (and their immediate families) of the Promoter, participating BP outlets and agencies associated with this promotion are ineligible to enter. 
3. The Promotion commences at 9.00am Australian Eastern Daylight Savings Time (“AEDST”) on 06/11/2008 and closes at 11.59pm AEDST on 04/12/2008 (“Promotion Period”). 
4. To be eligible to enter, individuals must recharge their mobile phone ( with the following carriers: Virgin, Vodafone, 3, Telstra, Crazy Johns Optus) to a minimum value of $20.00 using the e-pay system (“Eligible Purchase”) at any participating BP outlet in Australia during the Promotion Period. To enter, individuals must then send an SMS text message to 0447 926 833 including the last 5 digits of their unique e-pay recharge code number and their first name (in that order) during the Promotion Period. 
5. Standard SMS cost apply,please refer to your service provider for further details. SMS entry cost will vary dependent on the mobile network used but will not exceed 55c. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant. Service provider is TigerSpike Pty Ltd. ABN 66 106 294 731. 
6. Multiple entries permitted, subject to the following: (a) only one entry permitted per Eligible Purchase; (b) each entry must be submitted separately and in accordance with entry requirements;  (c) one entry per valid unique e-pay recharge code; and (d) the same unique e-pay recharge code cannot be used more than once; and (e) unrecognized e-pay recharge codes will be deemed invalid. Any form of automated entry using any other devices or software is invalid. 
7. Entrants must retain their unique e-pay code for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) and number must clearly specify the store of purchase and that the purchase was made during the Promotion Period but prior to entry.
8. The Promoter reserves the right to verify the validity of all entries (including an entrant’s identity, age and place of residence) and reserves the right to disqualify any entrant for tampering with the entry process, including but not limited to failing to provide proof of purchase for every entry they made during the Promotion Period, making multiple entries that are not associated with an Eligible Purchase, or for otherwise submitting an entry that is not in accordance with these terms and conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Incomplete or indecipherable entries will be deemed invalid.
10. There will be one (1) draw conducted for each week of the Promotion Period. Entries close for each draw at 11:59pm AEDST on the following dates 13/11/08 (Draw 1), 20/11/08 (Draw 2), 27/11/08 (Draw 3), 04/12/08 (Draw 4). The prize draws will take place at Level 1, 379 Crown Street, Surry Hills NSW 2010 on 14/11/08 (Draw 1), 21/11/08 (Draw 2), 28/11/08 (Draw 3), 05/12/08 (Draw 4) at 11:00am AEDST. All non-winning entries in each draw will be entered into subsequent draws. The entrant(s) drawn will be notified by mail & phone and will have their name and postcode published in The Australian on 09/12/2008. The Promoter’s decision is final and no correspondence will be entered into.
11. The first valid entry drawn each week will win the chance to play a Game to win AUD$20,000. The entrant (“Participant”) will be contacted by telephone and mail and a time will be agreed to play the Game to win the prize.  The Participant must provide proof of purchase to be eligible to play the Game. In the event that the Promoter has not been able to contact the Participant before the commencement of the Game, a representative of the Promoter will play the Game on the Participant's behalf and the Participant will be required to provide their proof of purchase to claim their prize.
12. The Game: The Promoter will contact the Participant by phone at the agreed time. There will be 100 x envelopes numbered 1 to 100 laid out at the Promoter’s office at the commencement of the Game. One (1) envelope will contain a “$20,000” prize message. The other 99 envelopes will each contain a $50.00 e-pay recharge message. The Participant/representative (“Attendee”) will be required to choose only one envelope by nominating a number from 1 to 100. A representative of the Promoter will then open the numbered envelope chosen by the Attendee and reveal the message inside . If the Participant selects the envelope which contains the “Win $20,000” message, subject to verification by the Promoter, the Participant will win AUD$20,000 in the form of a cheque made out to the winner. If the Participant selects an envelope which contains a $50 recharge message, then the $20,000 will not be given away and, subject to verification by the Promoter, the Participant will win a $50 e-pay recharge. Odds of selecting the $20,000 prize are 1:100.
13. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent/ guardian on their behalf.
14. Prize/s will only be delivered in Australia and the winner should allow 28 days from prize draw for delivery of their prize.
15. Total prize pool is valued at up to AUD $80,000. Prizes are not transferable or exchangeable.
16. The Promoter may conduct an unclaimed prize draw at the same place as the original draw on 06/03/2009 to distribute any prizes unclaimed by that date subject to any written directions from a regulatory authority. Winners (if any) will be awarded with the prize as originally selected by the Attendee in the original Game and will be notified by mail and phone & published in The Australian on 12/03/2009.
17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
19. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. Each entry becomes the property of the Promoter.
